These are the full terms and conditions of the Traksit online services (“Traksit Services”) provided by RF Shipping Limited (“RFS”) of 8 Thurloe Place, London SW7 2RX,Company Registration No: 05546328 and VAT No:869048777. This page tells you the terms and conditions on which we supply the Traksit Services listed on our website, www.rfshipping.com, (“our Site”) to You. Please read these terms and conditions carefully and make sure that you understand them before placing an Order. You should print a copy of these terms and conditions for future reference. To contact RFS in relation to these terms and conditions, email info@rfshipping.com. You should understand that by ordering any of our Services, You agree to be bound by these terms and conditions.

1. DEFINITIONS
   1. ‘AWB/Airway Bill’ means the documentation attached to the parcel.
   2. ‘Carrier’ means the third party courier company that delivers the Goods to the Consignee.
   3. ‘Consignee’ means the person whom You have authorised the Goods to be consigned.
   4. ‘You or Your’ means the person who purchases the Traksit Service.
   5. ‘Goods’ means the item(s) in our quotation property list/shipping request form and due to be sent to the Consignee’s address.
   6. ‘RFS Insurance Option’ means optional transit insurance cover to protect the Goods.
   7. ‘Prohibited Goods’ means those items listed in clause 4.
   8. ‘Restricted Goods’ means those goods listed in clause 3 and any other items that RFS in its absolute discretion deems a Restricted Goods.
   9. ‘Website’ means www.rfshipping.com
   10. ‘Working Day’ means exclusively to a standard UK working day, i.e. Monday to Friday from 9.00am to 5.30pm, excluding public or bank holidays.
2. ORDERS AND CANCELLATION RIGHTS
   1. A Contract (“the Contract”) between RFS and You is only complete and binding once RFS accepts the Order and confirms this to You in writing. RFS reserves the right to refuse or cancel any Order. RFS may also carry out payment and/or fraud security checks.
   2. The Order placed by You is with RFS. You accept however that the Goods are not carried or delivered by RFS, but by the Carrier. You can track its delivery on the Carrier’s website but any additional queries regarding carriage and delivery should be directed to RFS and RFS shall manage all communications with the Carrier on behalf of You. Orders placed by You are processed and forwarded automatically to the Carrier. RFS does not accept any liability for the incorrect input of information in an Order by You.
   3. Should the Carrier be unable to transit the Goods, You will be contacted by RFS with a possible alternative or right to cancel.
   4. You may cancel an Order up until one (1) hour prior to the Goods being collected from You. Refunds for cancelled Orders will only be issued if RFS has not been charged or has been refunded in full by the Carrier. Once the Goods have been collected, Orders cannot be cancelled.
3. RESTRICTED GOODS
   1. Restricted Goods may include items such as, but are not limited to, foods, plants, antiques, works/objects of art and fine art, banderols/tax stickers, furs and ivory, jewellery, watches, precious metals and/or stones and objects constructed of precious metal and/or stones; negotiable instruments in bearer form (whether cash like or not) which includes but not limited to blank or activated credit/cash dispenser cards, blank cheques, lottery tickets, money or postal orders, pre-paid phone cards, tickets, travellers cheques, vouchers/tokens and unused stamps, documents, money or valuable paper, certificates, passports, architectural models and prototypes, second hand items and items not in original packaging, household and personal items, furniture (unless in flat packs), animal food products, food for infants or medical consumption, fruit, vegetables and plant products, souvenirs made from endangered species.
   2. If You want to send Restricted Goods You must comply with all applicable regulations of the appropriate authorities in order to send such Restricted Goods. You assume full responsibility for compliance with any regulations and all liability and/or damage arising from carriage of those items. Any failure to comply with applicable regulations may also invalidiate any insurance under the RFS Insurance Option.
   3. By agreeing to these Terms and Conditions You are confirming that You understand what are classed as Restricted Goods, and the consequences of sending them.
   4. In the event Restricted Goods are delayed, returned or confiscated by any Customs officials, RFS will not issue a refund. In the event the Carrier returns any Restricted Goods to You, You shall be liable for any return charges.
4. PROHIBITED GOODS
   1. RFS does not permit the dispatch or delivery of Prohibited Goods. Prohibited Goods include live or dead animals, drugs, illegal narcotic substances, firearms (including parts) and ammunition, fake/dummy/game/toy weapons or replicas, paint ball guns, BB guns, antique weapons, swords, knives, fake grenades etc; items that could be used as weapons (these include but are not limited to decorative swords, kitchen knives etc); human remains (including ashes). Any Prohibited Goods sent through the Traksit Services will not be insured under any circumstances.
   2. In the event the Carrier must return any Prohibited Goods to You, RFS will not issue a refund and return charges may apply.
   3. Failure to declare Prohibited Goods may lead to prosecution.
5. CHARGES
   1. All prices stated on the Website are in Pounds Sterling. Any exchange rates provided are for guidance purposes only.
   2. Payments can only be made with a valid credit or debit card, or PayPal account.
   3. You shall pay all fees, freight charges, administration expenses and duties on demand.
   4. Payment is processed by our automated system after placing your Order and once the Traksit Service has been booked with the Carrier.
   5. Surcharges may be applicable, for example if the description of the Goods is entered incorrectly by You.
6. SURCHARGES
   1. Surcharges may be applicable for rescheduling the Traksit Service if incorrect information is provided by You. Any surcharge will be charged using the payment method used to make the original Order; if this is not possible You will provide an alternative payment method.
7. COLLECTION OF GOODS
   1. We cannot guarantee a specific collection date and time.
   2. In the event that the Consignee fails to take delivery of the Goods and the Carrier finds no alternative method of delivery, any charges incurred in re-delivering or returning the Goods to You may be charged to You.
   3. In the unlikely event that the Carrier does not make the collection, You should contact RFS immediately. RFS will attempt to rebook the collection for the same day, failing which, the next Working Day.
   4. RFS will not be aware of any issue, and will not accept liability, regarding collection until we are informed in writing by You.
   5. RFS may supply You with documentation to accompany shipments. If so, You will be informed at the time of ordering and in the subsequent confirmation email. If this documentation is not attached to the shipment it may cause delay and incur an additional premium, which You will be responsible for paying.
   6. Collections are only on Working Days
   7. If nobody is at the designated collection address at the collection time or the Goods are otherwise unavailable for collection, a Surcharge may apply.
   8. You should obtain a receipt as proof of collection. Collections require a bar-coded label/AWB to be printed by You and attached to their parcels. If so, this document will be displayed after placing the Order and will also be emailed to You. It must be printed and available before the courier arrives. If You do not receive this email it is your responsibility to contact RFS and inform them.
8. PACKAGING
   1. It is Your responsibility to ensure that the Goods are packed in a secure and satisfactory manner. Goods must be packed with a double walled cardboard box and the contents cushioned and protected inside. The packaging must sufficiently support the weight of the Goods.
   2. Goods transported using the Traksit Service of RFS and the Carrier must be able to withstand a short fall.
   3. Parcels shall not be joined together. Any such items will be treated as Prohibited Goods and may be seized by customs.
   4. Any insurance claim relating to a parcel that was not packed to a reasonable standard may be declined. See section 12 for further details.
   5. Prohibited Goods, Restricted Goods and unreasonably packaged Goods shall not be sent using RFS. If You ignore this, the Goods may be delayed, returned, impounded by Customs or held for collection by You or the Consignee, the collection of which must be arranged by a certain date. If so, a surcharge may apply. Please see section 7 for more information on surcharges.
   6. The Carrier and RFS reserve the right to refuse any Goods that do not comply with packaging standards or the information given by You in their order.
9. TRACKING AND DELIVERY
   1. RFS cannot guarantee a specific date and time of delivery
   2. Delivery dates and times are dependent on when the collection is made.
   3. Delivery dates and times are also dependant on the policies and procedures of the Carrier. For example, Fedex must be collected by 3pm to ensure next day delivery.
   4. Deliveries are made on Working days, or Saturdays if You purchase the Saturday surcharge. If such a delivery is not made on the Saturday as ordered, RFS will refund the cost of this service.
   5. It is Your responsibility to track their parcels and to advise RFS if there are any problems.
   6. RFS does not deliver to PO Boxes or BFPO addresses, only to complete actual street addresses.
   7. The Carrier will not deliver to individual departments or block numbers.
   8. If Goods are returned because an incomplete or incorrect street address was provided or because the address was an individual department or block number, RFS will not issue a refund.
   9. All Orders require the Consignee’s correct telephone number for queries by the Carrier regarding address. RFS will not issue any refunds or returned items if a telephone number has not been provided and the Carrier was unable to effect delivery due to this.
   10. For all Orders involving countries outside the European Union, a customs invoice must be completed. You can find a copy of a template customs invoices on the RFS Website. You must provide the Carrier with four signed copies of this invoice on collection.
   11. If customs discover inaccurate information or items different to those declared by You, a surcharge may be applicable.
10. CUSTOMS CLEARENCE
    1. RFS has no control over any interference with your Goods or charges by customs.
    2. Any charges by customs must be paid by the Consignee before delivery is made
    3. If the Consignee or You refuse to pay these charges the Goods will be returned and You will be required to pay the cost of the return delivery and any other relevent charges.
11. INSURANCE
    1. The RFS Insurance Option provides cover to Your Goods in accordance with the attached policy summary of terms.
    2. Should an incident occur which may give rise to a claim, You should inform RFS immediately and request a standard claim form.
    3. Upon receiving a complete claim form, RFS shall notify its insurers within seven days of receipt thereof.
    4. In the event of any such claim, You agree to provide any information requested by the insurer or the insurer’s appointee, and RFS may send You copies of any correspondence with the insurer in relation to the claim.
    5. In the event that the claim is made by RFS under its own insurance cover, RFS shall pay or arrange to pay that part of any proceeds to You.
    6. RFS is under no obligation to commence legal proceedings or threaten the same in relation to any such claim.
    7. You should use due diligence and best endeavours in all matters relating to the claim, whether before or after an incident occurs, and must take all reasonable precautions to prevent an incident that could give rise to a claim.
    8. RFS does not provide any advice concerning its insurance cover and it is for You to read the policy summary of terms and to decide if it is adequate.
12. Our Liability
    1. If we fail to comply with these terms and conditions, we shall only be liable to You for the purchase price of the Traksit Service.
    2. We will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories even if such losses result from our deliberate breach:
       
       a) Loss of income or revenue;
       b) Loss of business;
       c) Loss of profits;
       d) Loss of anticipated savings;
       e) Loss of data.
    3. However, this clause 12 will not prevent claims for loss or of damage to your physical property that are foreseeable or any other claims for direct loss that are not excluded by categories (a) to (e) inclusive of this clause 12.2.
13. Our Right To Vary These Terms and Conditions
    
    We have the right to revise and amend these terms an conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
14. Import Duty and Local Taxes
    1. Orders with the Traksit Service delivery outside the UK may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. The Consignee will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
15. Events Outside Our Control
    1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
    2. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
       
       a) Strikes, lock-outs or other industrial action;
       b) Civil commotion, riot, invasion, terrorist attack or threat attack, war (whether declared or not) or threat or preparation for war;
       c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
       d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
       e) Impossibility of the use of public or private telecommunications network;
       f) The acts, decrees, legislation, regulations, or restrictions of any government; and
       g) Pandemic or epidemic.
    3. Our performance under these terms and conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
16. Law and Jurisdiction
    
    Contracts for the purchase of the Traksit Services through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with these terms and conditions or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
17. Third Party Rights
    
    A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
